Definitions
Affiliate Sites
Affiliate Sites include platforms on which PPVNetworks promotes Content and Producers (including, for example, X) as well as sites with which PPVNetworks has affiliate marketing relationships (including, for example, Pornhub and Gaydemon). PPVNetworks relies on Affiliate Sites for promotional purposes through the use and placement of screenshots, textual descriptions of Content and/or previews, typically 120 seconds of less. Affiliate Sites contains referral links to PPVNetworks Sites for purposes of tracking and compensation to affiliates.
Content
Content refers to any depiction, whether visual or auditory, photographic, phonographic or videographic, of an actual human being, or multiple human beings, that is viewable on Sites and was uploaded by a User or Producer. Content includes but is not limited to material that is sexually explicit. Publishing Rules apply to all Content in all contexts, including on all Sites and Affiliate Sites.
Producers
Producers create accounts on Sites for the purpose of commercialization of their Content. Each Producer goes through an application and review process. If approved, Producers are permitted to upload Content. Their Content is featured on their channel and available in other areas of Sites.
By using the Sites, Producers agree to comply with Publishing Rules.
Sites
PPVNetworks operates a network of adult websites, herein referred to as PPVNetworks Sites or just Sites, including but not limited to Raw Fuck Club, Raw Fans and Black Breeders. PPVNetworks reserves the right to add or remove Sites to its network at its discretion.
Studio
A Studio is an entity in the business of the professional production, distribution, or dissemination of Content. PPVNetworks has contractual licensing relationships with Studios, Dark Alley Media. Studios agree to comply with the Publishing Rules, 18 U.S.C.§ 2257, and all other applicable legal and regulatory requirements.
Users
Users create accounts on Sites for the purpose of social media interactions with other Users, and/or purchasing access to Content in the form of membership plans and downloads. Users can create personal profiles which permit them to upload non-commercial Content ("user-submitted content") that can be shared with other users in their profiles, albums, posts, comments and messages on Sites.
By using Sites, Users agree to comply with Publishing Rules.
MasterCard/VISA Regulations
MasterCard and VISA require us to enforce a set of regulations. These regulations have been contextualized and integrated into our policies and Publishing Rules.
- Producers must complete an application which is subject to approval by PPVNetworks prior to being permitted to upload and manage content.
- Producers' age and identity must be verified by providing (a) government-issued Photo ID, i.e. passport or driver's license; (b) an additional ID, ie. bank/credit card, birth certificate, social security card, or voter registration and (c) a selfie holding Photo ID. All photos must be color, unretouched, and high resolution. All text must be clear and legible.
- Producers are required to digitally sign an attestation of compliance stating that they have read, understand and fully agree to the Publishing Rules. By agreeing to these Publishing Rules and using the Sites, Producers agree that the Content they are uploading is fully compliant with all applicable laws and regulations, and that it is Producers' responsibility to maintain such compliance.
- Producer requirements and obligations for each upload, include but are not limited to:
- Producer has consent, as per allowed mechanisms in these Publishing Rules, for all models that appear in Content;
- Producer has obtained identity and age documentation from all models that appear in Content including a government-issued Photo ID, i.e. passport or driver's license; and a selfie holding Photo ID. All photos must be color, unretouched, and high resolution. All text must be clear and legible.
- Models must be 18 years of age or older.
- Producer must keep on record copies of consent documents and be able to provide these digitally and immediately upon request from PPVNetworks;
- Producer must keep on record copies of ID and consent documents and be able to provide these digitally and immediately upon request from PPVNetworks;
- Content that violates any Federal, State or local laws; or objectionable content, is explicitly prohibited. Illegal acts include, but are not limited to, sex with real or perceived minors (under the age of 18), simulated or real non-consensual sex (including but not limited to forced sex or rape), simulated or real incest, sex with animals (bestiality), sex involving "obscenty" as defined by the U.S. Department of Justice's Citizen's Guide To U.S. Federal Law On Obscenity and other applicable law and regulations, use of illegal drugs, soliciting sex, or sex trafficking.
- Content shall be entirely original and not infringe upon any third-party rights, copyrights, title or interest. Producer indemnifies PPVNetworks from any and all claims or damages made against PPVNetworks or suffered by it relating to Content;
- Producer represents and warrants that its intellectual property rights with respect to the Content are not contested;
- Producer will review the latest versions of these requirements regularly for changes and Content that falls out of compliance will be removed.
- Content is subject to both automated validation, such as checking for red flag and banned words, as well as human visual inspection and review prior to publishing.
- Content that may be perceived as being illegal, even if not in fact illegal, may be removed in the sole discretion of PPVNetworks. Examples include models that look too young, despite having proof of legal age, and simulated illegal acts;
- If PPVNetworks identifies illegal or objectionable Content, it will be immediately flagged and the account will be subject to immediate review. PPNetworks reserves the right in its sole discretion to revoke permissions, terminate accounts, remove Content, and refer violations to law enforcement or appropriate authorities;
- In the event a user believes there is an issue with Content, such as violating the law or being objectionable, the user can file a complaint. "Report issue with content" links are available for all Content on Sites. User is provided a list of reasons to choose from, "Technical problem, Violent or repulsive content, Hateful or abusive content, Harmful dangerous acts, Child abuse, Infringes my rights." Once chosen, the appropriate form is presented. PPVNetworks policy is to review and resolve all reported content complaints within seven (7) business days. In the event there is evidence of illegal content, it will be removed immediately. In the context of MC/VISA regulations, the appropriate entities will be notified of the event. Reporting of user complaints, as well as the steps taken to resolve the complaints, is logged and retained for compliance purposes;
- Producers may be subject to random, or targeted, review by PPVNetworks to verify that Producer is compliant with obligations including but not limited to documentation requirements.
Application & Review Process for Producers
Producers must complete an application which is subject to approval by PPVNetworks prior to being permitted to upload and manage Content. Producers' age and identity must be verified by providing (a) government-issued Photo ID, i.e. passport or driver's license; (b) an additional ID, ie. bank/credit card, birth certificate, social security card, or voter registration and (c) a selfie holding Photo ID. All photos must be color, unretouched, and high resolution. All text must be clear and legible.
As part of the application process, Producer must sign an attestation of compliance stating that they have read, understand and agree to the Publishing Rules.
Uploading Content
Producers are required to digitally sign an attestation of compliance stating that they have read, understand and fully agree to the Publishing Rules, which has language requiring the Content meet certain requirements, and that they are responsible to maintain such compliance. Producers are required to reaffirm this attestation and digitally sign with every upload.
Producer requirements and obligations for each upload:
- Producer has obtained consent from all models that appear in Content;
- Producer has obtained identity and age documentation from all models that appear in Content including a government-issued Photo ID, i.e. passport or driver's license; and a selfie holding Photo ID. All photos must be color, unretouched, and high resolution. All text must be clear and legible.
- Models must be 18 years of age or older.
- Producer must keep on record copies of ID and consent documents and be able to provide these digitally and immediately upon request from PPVNetworks;
- Content that violates any Federal, State or local laws, or objectionable Content, is explicitly prohibited. - Producer must make sure that Content does not contain any of red flag or banned words, or any other words that describe prohibited acts. A list of red flagged and banned words can be viewed here: RED FLAG & BANNED WORDS
- Content is entirely original and does not infringe upon any third party rights, copyrights, title or interest. Producer indemnifies PPVNetworks from any and all claims or damages made against PPVNetworks or suffered by it relating to Content;
- Producer will review the latest versions of these requirements regularly for changes and Content that falls out of compliance will be removed.
Model Consent for Producers
By agreeing to these Publishing Rules and using the Sites, Producers consent to the following provisions if they appear as a model in any Content:
- You attest that you are a participant in adult-themed content in which all participants, including yourself, are over the age of 18.
- You grant PPVNetworks the absolute right and permission to exploit your explicit and non-explicit Content in any form, manner or format, including but not limited to streaming previews and premium full-length content, available for unlimited access in plans purchased by Users or as pay-per-view purchased by Users, or as download-to-own purchased by Users, including on PPVNetworks Sites, and Affiliate Sites including but not limited to social media.
- You grant PPVNetworks a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, edit, modify, adapt, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the services provided by PPVNetworks and its successors and Affiliates. This includes, but is not limited to, the right to edit the content for clarity, length, and compliance with regulatory guidelines.
- You agree that media featuring yourself and/or your likeness will be used for commercial purposes.
- You warrant that you are over the age of 18 and that you have the right to contract in your own name.
- You have read these Publishing Rules, including the above authorization, release and agreement prior to granting your consent, and you fully understand what you are agreeing to.
- This consent applies to any and all Content depicting you or in which you hold any right or interest, for an indefinite period of time.
- If you have questions or concerns relating to the exploitation of your Content, or if you wish to withdraw this consent, for any or all Content in which you are featured, you can do so at any time, for any reason, using the video management tools in your Producer account, or you can email support@ppvnetworks.com .
- You agree to allow this consent document and your photo IDs to be stored by PPVNetworks shared with third parties for any lawful purpose.
Consent for Models
- Producer must obtain consent from all models that appear in Content, in one the following ways:
- model is a Producer* (online at Sites)
- model is registered* (online at Sites)
- PPVNetworks written blanket release (PDF, available at Sites)
- third-party written blanket release (scan of third-party document)
- third-party written video-specific release (scan of third-party document)
*Producers and registered models have had their photo ID and digitally-signed consent approved by PPVNetworks.
- Models can provide ID and consent by registering at the Sites, including at rawfuckclub.com/register. This is the recommended mechanism to provide ID and consent.
- PPVNetworks blanket releases are available in PDF format at the Sites, including at rawfuckclub.com/modelrelease, for circumstances where online consent is not possible or convenient.
- Third-party releases are subject to approval by PPVNetworks and must meet include verbiage that warrants the model is over 18 and grants PPVNetworks the absolute, unrestricted and perpetual right for PPVNetworks Sites and Affiliate Sites to commercialize videos in which the model appears, in any format, including but not limited to streaming and downloads.
Copyrights
Content shall be entirely original and not infringe upon any third-party rights, copyrights, title or interest. Producer indemnifies PPVNetworks from any damages suffered by it as relating to Content; Producer represents and warrants that its intellectual property rights with respect to the Content are not contested;
Restrictions
- You may not use this Site for the advertising of sexual services or to engage in illegal activities, including activities requiring the payment of money for sex.
- You may not link to any website, web page, post, blog, writing, or media of any type that suggests or contains any illegal activity.
- You may not use this Site to request or send money, or any other form of financial assistance, from or to any person or User that you communicate with on this Site.
No Illegal or Objectionable Acts
Content that violates any Federal, State or local laws, or objectionable Content, is explicitly prohibited. Illegal acts include, but are not limited to, sex with real or perceived minors (under the age of 18), simulated or real non-consensual sex (including but not limited to forced sex or rape), simulated or real incest, sex with animals (bestiality), sex involving "obscenity" as defined by the U.S. Department of Justice's Citizen's Guide To U.S. Federal Law On Obscenity and other applicable law and regulations, use of illegal drugs, soliciting sex, or sex trafficking.
Review of Producer Submitted Content
Every upload is subject to automated and human review prior to publishing. Human review can be time consuming. As such, our content management system (CMS) assigns uploads to content managers and they are queued for processing. Producers can view the status of the uploads in the admin area of their account. Once approved, Content can is scheduled for release.
Automated review processes assist content managers and force certain mandatory required checks. Additionally, certain checks occur periodically, automatically.
An example of an automated review process:
- Model count checks that compare the visually-inspected number of models, as reported by content manager, to number of models assigned to Content by the Producer.
An example of a periodic, automated review process:
- Detection of red flag and banned words in Content, associated channel descriptions, and social media comments/posts.
- Banned and red flag words can be added to the system at any time, and it is important to maintain continuing compliance by checking for these words periodically.
- Red flag words trigger a more comprehensive human review process of Content, channel descriptions, and social media comments/posts that appear on Sites.
- Banned words also trigger a review process, however, these words themselves are banned from appearing on Sites, regardless of context. Banned words are prohibited from search and indexing.
- Nearly 300 words are currently organized into 10 categories: forced sex, illegal acts, oscene acts, offensive acts, acts while sleeping, trafficking and prostitution, underage acts, acts while under the influence, and violent acts.
Content managers, as part of their review, watch all submitted Content in their entirety. Subsequently, they complete their non-compliance and compliance review, including:
- Non-compliance tasks include determining if Content meets the basic requirements for premium Content, including but not limited to duration, resolution, codecs, competitive watermarks, number of models, use of condoms, production quality, videographic quality, and reuse; reviewing and editing previews within specified parameters, such as duration, and marketability, and choosing corner for branded watermarks to be overlayed; making sure there is no third party branding, watermarks, or signs of third party involvement in the Content; approving and/or choosing screenshots based on quality and marketability, and categorizing Content by theme; reviewing previews and screenshots to make sure they best represent the Content, determining positioning of Content in various areas of the sitem ie. "What's Hot," or direct-to-channel; pricing download-to-own; reviewing Producer specific notes, such as special requests for how to edit previews or the order to release a batch of scenes; and scheduling Content.
- Compliance review tasks include verifying models match those assigned by Producer; provide a visual count of models; making sure prohibited illegal or objectionable activities, or depictions of these activities, do not exist in the Content.
- Such activities include, but are not limited to, child pornography or models that "visually appear" to be underage; non-consensual or forced sex (including sex under the influence of alcohol or drugs, or sex with a partner that is not fully awake or fully coherent); soliciting sex; child trafficking; use of illegal drugs; obscene acts (such as scat) and violent acts (such as bloodsport, induced pain or torture). Content that fails inspection goes into our purgatory system and the Producer is flagged for review.
- Purgatory is a highly restricted area that is unavailable to the public (ie., that requires backend system access using a VPN), yet allows us to have a repository for future review of questionable Content. Producers that have Content flagged are subject to an account review, and possible termination, or referral to law enforcement or other authorities.
User Complaint Process (aka "Report Content")
- In the event a user believes there is an issue with Content, such as violating the law or being objectionable, the user can file a complaint. "Report issue with content" links are available for all Content on Sites. User is provided a list of reasons to choose from, "Technical problem, Violent or repulsive Content, Hateful or abusive Content, Harmful dangerous acts, Child abuse, Infringes my rights." Once chosen, the appropriate form is presented.
- PPVNetworks policy is to review and resolve all reported Content complaints within seven (7) business days. In the event there is evidence of illegal Content, it will be removed immediately. Reporting of user complaints, as well as the steps taken to resolve the complaints, is logged and retained for compliance purposes.
- Any person depicted in Content can request for that Content to be removed. PPVNetworks will remove the Content from Sites, or the complainant from the Content, within seven (7) business days.
- If Content is placed into purgatory (removed), or a Producer terminated, the Producer and complainant will be notified of these actions. As determined by PPVNetworks, there are situations where a Producer may be given the opportunity to explain or prove why they believe a complaint was in error. Only when both the complainant and complainee are in agreement that a complaint and/or subsequent resolution by PPVNetworks were in error, will a resolution be undone.
- In the context of MC/VISA regulations, the appropriate entities will be notified of complaints and resolutions.
Complaint Report for Acquirer (aka "Transparency Report")
- Complaint Report for Acquirer provides a listing of all complaints, including reported content, complainant's username/email address, date of complaint, date of resolution, reason category, description of complaint, URLs of Content reported, status of complaint, and more.
- Timestamped response actions taken by PPVNetworks to resolve the complaint are logged and associated with the complaint.
- Once a month, we email the report providing the prior month's complaints to the appropriate entities.
User Content
Subject to these terms of use, provisions and conditions, users may share or message photographs, images, comments, identifying information, videos, and other User Content to this Site. When placing User Content on this Site, you are reminded that other users of this Site will have full access to all such content and that all such postings are non-confidential. Although legally not permitted to do so, users may copy and further disseminate User Content. You understand and acknowledge that by placing User Content on this Site, all such content may be viewed by and/or forwarded to anyone by anyone and/or retained by anyone and/or utilized by anyone forever (even if User Content is removed from this Site). User Content could be indexed, referenced, stored and re-printed by other users of this Site (even if User Content is removed from this Site to the extent that such other users may have downloaded or otherwise copied information from this site before removal). PPVNetworks is not required to install measures to prevent the copying of User Content by third parties and is not required to take legal action on Your behalf against such third parties.
Review of User Submitted Content
You understand and acknowledge that PPVNetworks, consistent with its “Good Samaritan” rights under 47 U.S.C. §230, has the right at PPVNetworks’s sole and absolute discretion to review, delete, or refuse to post any information or material submitted for publication on this Site. Without limitation, PPVNetworks reserves the right to terminate your use of this Site and/or to remove and/or edit any User Content, information, and/or material that (A) PPVNetworks believes violates these terms or use, provisions and conditions or otherwise breaches your agreements with PPVNetworks; (B) creates any liability whatsoever for PPVNetworks (known or unknown); and/or (C) PPVNetworks deems objectionable or otherwise inappropriate. The foregoing notwithstanding, PPVNetworks’s failure to take any of the foregoing actions shall not, and shall not be deemed to, create any liability whatsoever for PPVNetworks.
Consequences of User Submitted Content
You are solely responsible for any information you share with any user either through the Site or otherwise and you specifically acknowledge that any information you share with another user should be considered public information. PPVNetworks has no control and takes no responsibility for any information you share with any user which is then used, shared, or in any way allegedly or misused. In such event, you acknowledge that your dispute will be directly with the user you believe to be responsible.
No Agency/Employment Relationship
Except as specifically set forth in these terms of use, provisions, and conditions, your use of this Site and the content hereof and/or any third party site and the content thereof, and the provision of any information while using this Site or any third party site (including, without limitation, e-mail services, if any) shall not create and/or constitute any business, joint venture, or other relationship between you and PPVNetworks. PPVNetworks does not undertake any duty to supervise any User Content or activity through the Site at any time.
